Class actions are "group actions" which enable people who have been harmed in a relatively small way to pool their grievances with others who have been similarly mistreated – collectively they sue the company which is acting unlawfully. A class action can operate as a check on improper corporate behavior. Without a class action, a company that has obtained a large profit by taking small amounts of money from a large group of people will continue doing business as usual because very few people can afford to file a lawsuit over a small sum. And many times, even if sued in an individual lawsuit, a company may treat small lawsuits as just a cost of doing business. As Judge Richard Posner succinctly put it: “The realistic alternative to a class action is not 17 million individual suits, but zero individual suits, as only a lunatic or a fanatic sues for $30.” However, if the company steals from many, and the claims can be handled in a single lawsuit, a class action may be appropriate.
